THE HON'BLE SRI JUSTICE T. SUNIL CHOWDARY CIVIL MISCELLANEOUS APPEAL No.917 OF 2016 JUDGMENT:
This civil miscellaneous appeal is filed under Order XLIII Rule 1 of CPC challenging the order dated 01.11.2016 in I.A. No.1139 of 2016 in Election O.P. No.478 of 2016 on the file of the Court of Principal District Judge, Krishna at Machilipatnam. 2.
Heard the learned counsel for the appellant and the learned counsel for the first respondent.

The learned counsel for both the parties, in one voice, submitted that instead of disposing of the appeal on merits, the trial court may be directed to dispose of the Election O.P. as early as possible. In view of the submission made by the learned counsel for both the parties, this court is not inclined to express any opinion touching the merits of the impugned order. 4.
Having regard to the facts and circumstances of the case and also the submissions made by learned counsel for both the parties, the trial court is hereby directed to dispose of Election O.P. No.478 of 2016 as expeditiously as possible, preferably within a period of six months from the date of receipt of a copy of this order. The appellant is at liberty to urge the points raised herein, before the trial court.

With the above direction, the civil miscellaneous appeal is disposed of. Miscellaneous petitions, if any pending in this miscellaneous appeal, shall stand closed.
