This criminal petition is filed under Section 482 Cr.P.C. seeking to dispense with the presence of the petitioner in C.C.No.279 of 2011 on the file of Additional Judicial Magistrate of First Class, Amalapuram, East Godavari Districtf, registered against the petitioner/A1 for the alleged offences punishable under Sections 452, 427, 324, 323, and 506 read with 34 IPC.
Heard learned counsel for the petitioner and learned Public Prosecutor appearing for the State.
A perusal of the material on record reveals that specific allegations were made against the petitioner. The truth or otherwise of the allegations can only be decided during course of trial. I see no ground to interdict at this stage and quash the proceedings. In the facts and circumstances of the case and as requested by the learned counsel for the petitioner, the criminal petition is disposed of, directing the trial court to dispose of the case as expeditiously as possible preferably within a period of six months from the date of receipt of a copy of this order, without insisting the presence of the petitioner/accused No.1 unless required for any specific purpose.
