THE HON'BLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.20206 OF 2016 ORDER:
The writ petition is filed by the petitioners seeking a writ of mandamus declaring the action of the respondents in passing the impugned orders in F.No.AICTE/AB/SCR/2016/1-2867016581, dated 10.06.2016, without considering the documents submitted by the petitioners and without giving any opportunity of being heard as illegal and arbitrary, and consequently to set aside the same.
Heard and perused the material.
Learned counsel for the petitioners confines his arguments with regard to personal audience of the petitioners before the first respondent and to that effect, he seeks a direction to the first respondent to give personal hearing before taking any decision for approval of the petitioners. Learned counsel appearing on behalf of the respondents submits that the first respondent will take any decision with regard to approval of the petitioners in terms of the Judgment of the Hon'ble Supreme Court in Parshavanath Charitable Trust v All India Council for Technical Education (2013 (5) SCJ 384), (Parshavanath Charitable Trust, for brevity) .
Considering the facts and circumstances of the case, the first respondent is directed to give personal hearing to the petitioners herein prior to take any decision with regard to approval of the petitioners and to pass appropriate orders in terms of the Judgment of the apex Court in Parshavanath Charitable Trust.
The writ petition is accordingly disposed of. Consequently, miscellaneous petitions, if any shall also stand disposed of. _____________________ JUSTICE RAJA ELANGO 08.11.2016 pln
