HON'BLE SRI JUSTICE S.V. BHATT W.P.No.10869 OF 2016 ORDER:

The learned Government Pleader (Revenue) consents to disposing of the writ petition.

The petitioners rely upon D-form pattas, pattadar passbooks and title deeds issued in their favour for agricultural land in an extent of Ac.2-00 cents in Sy.No.400/2, Ac.2-00 cents in 400/3 and Ac.2-00 cents in 400/4 respectively of Karuchola, Village, Edlapadu Mandal, Guntur District.

Now the complaint of petitioners is the respondents without recourse to law are interfering with their possession and enjoyment. This Court granted interim direction restraining the respondents from interfering with the petitioners' peaceful possession without following the due process of law.

After perusing the material available on record, this Court is satisfied that the prayer demands the respondents to follow the procedure in the event of petitioners' dispossession.

Hence, the writ petition is disposed of by directing the respondents not to interfere with petitioners' possession and enjoyment, except in accordance with law. The merits of the writ averments are not considered or decided by this order. It is for the respondents to consider the merits as and when the matter is enquired into and decided. There shall be no order as costs.

Consequently, pending miscellaneous petitions, if any, stand closed.
