HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 31058 of 2018 ORDER:

1) The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of respondents 2 and 3 in not considering the representations of the petitioners dated 08.03.2018 and 18.04.2018 and not taking any action against respondent No.4 for closure of Recharge Kunta (Bavi) situated at Kagithalagudem Ilaka, Hajarethgudem Village, Cumbum Mandal, Prakasam District, as illegal and arbitrary. 2) The Government Pleader for Revenue (AP), who took time to get instructions, placed on record the written instructions, wherein it is mentioned that the Gram Panchayat had passed a resolution No.3 dated 08.02.2018 to allot the entire extent of Ac.0.04 cents covered in S.No.14 (Well) for construction of Sri Sri Sri Madvirat Pothuluri Veera Brahmendra Swamy Vari Temple.

Taking advantage of the same, some persons interested have started the work of closing the said Well. On receiving the information, the Tahsildar, Cumbum, directed the Village Revenue Officer, to stop the above work and accordingly, the Village Revenue Officer stopped the action of closing the Well. It is further stated that a Board was displayed in front of the Well with a warning that Well should not be closed and the trespassers would be punished severely in accordance with law.

3) Having regard to the above, it appears that the grievance of the petitioners has been attended to. Accordingly, the Writ Petition is closed.

4) Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed. There shall be no order as to costs.
