N. Venugopal Rao, v. Sri Karikalan Valaven. I.A.S.,
THE HON'BLE SRI JUSTICE V. RAMASUBRAMANIAN AND THE HON'BLE SRI JUSTICE G. SHYAM PRASAD CONTEMPT CASE No. 469 of 2016 ORDER: (Per VRS,J) This contempt petition is filed alleging the non-compliance with a direction contained in another contempt petition. 2.
The direction contained in the order, dated 16.11.2015, passed in a contempt petition No.2014 of 2015, reads as follows: "We hope and trust that appropriate decision under F.R.54B would be taken within a maximum period of two months from the date of receipt of a copy of this order." 3.
Unfortunately, in the original writ petition, the Government was only a respondent and it was the Greater Visakhapatnam Municipal Corporation which was the writ petitioner. In the contempt petition, the Government alone was made a party. No particular direction either to the Government or to the Municipal Corporation was given. Therefore, in the absence of the Municipal Corporation being a party, we do not know who has to implement the above order. Therefore, leaving it open to the petitioner to work out his remedies against the Greater Visakhapatnam Municipal Corporation, this Contempt Petition is closed.
VRS,J & GSP,J CC No.469 of 2016 Consequently, miscellaneous petitions if any pending in the writ petition shall stand dismissed. No order as to costs. __________________________ V. RAMASUBRAMANIAN, J _____________________ G. SHYAM PRASAD, J 24th October, 2016 cbs
