THE HONOURABLE SMT. JUSTICE K. SUJANA CRIMINAL PETITION No.13983 of 2025 ORDER:

This Criminal Petition is filed seeking the Court to enlarge the petitioner, on bail, who is arrayed as accused No.1 in Crime No.669 of 2025 before the Rajendranagar Police Station, Cyberabad Commissionerate.

The brief facts of the case are that on 17.06.2025 at about 1930 hours, near a pan shop located beside Deccan Elite Hotel, Rajendranagar, an altercation took place between the complainant and one Virushat Khan along with three others. During the scuffle, it was alleged that Virushat Khan stabbed the complainant multiple times on the head and back with a knife, causing bleeding injuries, and thereafter fled from the spot.

Heard Sri Bathini Upendar, learned counsel appearing on behalf of the petitioner as well as Sri D. Arun Kumar, learned Additional Public Prosecutor appearing on behalf of the respondent - State.

Learned counsel for the petitioner submitted that the petitioner was an innocent person and was falsely implicated due to previous enmity with the de facto complainant and that the complainant himself had picked up a quarrel on the said date, and during the scuffle, he accidentally sustained minor injuries which were simple in nature. He further submitted that the entire investigation was completed, statements of witnesses were recorded, and hence, the continued detention of the petitioner was unwarranted. Therefore, he prayed the Court to grant bail to the petitioner by allowing this criminal petition.

On the other hand, learned Additional Public Prosecutor vehemently opposed the submissions made by learned counsel for petitioner, stating that the allegations leveled against the petitioner are serious in nature. Further, the investigation was not yet completed. At this stage, granting of bail to the petitioner does not arise. Therefore, he prayed the Court to dismiss the Criminal Petition.

In the light of the submissions made by both the learned counsel and on a perusal of the material available on

record, it appears that a quarrel took place between the petitioner and the de facto complainant, during which the petitioner attacked the de facto complainant with a knife. As seen from the record, the injury certificate shows that the complainant sustained simple injuries.

Further, the petitioner has been in jail since 02.10.2025. It is the specific contention of the learned counsel for the petitioner that the petitioner has examinations commencing from 19.12.2025 and filed examination schedule to that effect. Considering the facts and circumstances of the case, as well as the forthcoming examinations of the petitioner, this Court deems it fit to grant bail to the petitioner subject to the following conditions:

i.

The petitioner shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only), with two sureties for a like sum each to the satisfaction of the learned XI Additional Metropolitan Magistrate, Cyberabad Commissionerate, Rajendranagar, Ranga Reddy District.

ii.

The petitioner shall appear before the concerned SHO at 11:00 a.m., on

every Sunday for a period of eight (8) week or till filing of charge sheet whichever is earlier, for the purpose of investigation, and thereafter, as and when required.

iii.

The petitioner shall abide by the conditions stipulated in Section 437(3) of Cr.P.C.(presently, Section 480(3) of the BNSS).

Accordingly, the Criminal petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
