HON'BLE SRI JUSTICE S.V. BHATT WRIT PETITION No.28256 OF 2009 ORDER:
The petitioner challenges the Proceeding No.736/A1/09 dated 09.12.2009, as illegal, cryptic and violative of principles of natural justice.
On 23.12.2009, this Court granted interim suspension of the proceedings dated 09.12.2009. Counsel for the petitioner submits that by virtue of the interim suspension, the petitioner has been working as "Anganwadi Worker".
Be that as it may, adverting to the grounds of challenge against the proceeding, this Court is in agreement with the contention of counsel for the petitioner that having received the explanation of petitioner, refusing the explanation with the mere observation that the explanation is not satisfactory, is untenable. The impugned proceeding does not refer to any of the details which compel the respondents to issue the impugned proceeding. The impugned proceeding is set aside on this short ground, matter is remitted to 2nd respondent for consideration and passing appropriate orders within eight weeks from the date of receipt of a copy of this order. The petitioner is given liberty to make, if so advised, additional explanation by enclosing a copy of this order within four weeks from today. The writ petition is ordered as indicated above. No order as to costs.
Miscellaneous petitions, if any, pending in the writ petition shall stand closed.
