HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.28220 OF 2017 ORDER:

The first petitioner is stated to be a businessman dealing with rice at Talabkatta, near Railway Bridge, Hyderabad, whereas the second petitioner is the owner of Tata Mini vehicle bearing Registration No.TS 07 UB 2430. While so, on 27.07.2017, the third respondent received a complaint that in the said vehicle, the broken rice was being transported from Yakutpura to Chetanpally village of Farooqnagar Mandal, Ranga Reddy District. The third respondent stopped the vehicle, conducted inspection and found 70 bags of broken rice equivalent to 36 quintals. He conducted Panchanama and now the proceedings under Section 6-A of the Essential Commodities Act are pending before the second respondent. The petitioners submitted an application before the District Supply Officer for release of the stock as well as the vehicle, and when no orders are passed, the present writ petition is filed.

It is admitted by the learned counsel for the petitioners that the District Supply Officer is not competent officer to release the seized stock and the vehicle. In view of the same, the writ petition is disposed of giving liberty to the petitioners to apply to the second respondent, and as and when petitioners apply for release of the seized stock and the vehicle, the second respondent shall pass appropriate orders within a period of two weeks thereafter.

The writ petition is accordingly disposed of. Consequently, miscellaneous petitions pending, if any, shall stand closed. __________________________ A.RAMALINGESWARA RAO, J 23.08.2017 pln
