THE HON'BLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.25938 OF 2015 ORDER:
The writ petition is filed seeking a writ of mandamus declaring the action of the respondents in not providing information pursuant to the petitioner's representation dated 24.07.2015 in relation to the alleged enquiry and the orders passed basing on the petitioner's representations dated 02.09.2013 and 08.07.2014 and closing of the case, as illegal and arbitrary, and further direct the respondents to furnish information sought by the petitioner vide his representation dated 24.07.2015.
Heard and perused the material.
The petitioner approached this Court by filing writ petition being W.P.No.34228 of 2014 seeking a direction to the respondents to act upon the complaint of the petitioner and conduct a thorough investigation by the Central Bureau of Investigation (CBI). In the said writ petition, the second respondent herein has filed counter affidavit stating that the matter is already enquired on the complaint of the petitioner and the case has been closed by the Government. In pursuance of the same, the petitioner made a representation, dated 24.07.2015, to the respondents 1 and 2 seeking to furnish a copy of the Order passed by the Government.
The present writ petition is filed before this Court even prior to take any decision by the respondents 1 and 2 on the representation of the petitioner, dated 24.07.2015, and as such, this Court is of the view that the writ petition is premature in nature. The petitioner is at liberty to approach this Court at appropriate time seeking appropriate relief. The writ petition is devoid of any merits and is liable to be dismissed.
The writ petition is accordingly dismissed. Consequently, miscellaneous petitions, if any shall also stand dismissed. _____________________ JUSTICE RAJA ELANGO 02.01.2017 pln
