THE HON'BLE THE CHIEF JUSTICE SRI KALYAN JYOTI SENGUPTA AND THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.10084 of 2015 Order: (per the Hon'ble the Chief Justice Sri Kalyan Jyoti Sengupta) Learned counsel for the respondents does not want to file any counter affidavit in this matter.
Hence, we dispose of the Writ Petition finally by the following order: In this Writ Petition, it has been contended that the demand made by the respondent - Gram Panchayat is illegal, as the claim is stale one. It appears that the objection raised by the petitioner is to be heard out by the appropriate officials of the Gram Panchayat.
We therefore direct that the respondent - Gram Panchayat shall decide the issue, after giving a personal hearing to the petitioner. This decision shall be taken with reasons within a period of three weeks from the date of communication of this order. Till such decision is taken, no coercive measures shall be taken.
The Writ Petition is accordingly disposed of. Pending miscellaneous petitions, if any, shall stand closed. No order as to costs.
