THE HON'BLE SRI JUSTICE P.KESHAVA RAO WRIT PETITION NO. 12320 OF 2015 ORDER:

There is no representation on behalf of the petitioner. 2.

The prayer sought in the Writ Petition is as under: " ...to declare the action of the Respondent No.4 in not accepting to receive without assailing any reasons the amounts collected by the Petitioner as MPKBY agent from the Recurring Deposit holders under her being licenced agent for the last so many years as illegal, arbitrary, and even against to principles of natural justice and direct the Respondents to receive the amounts collected by the Petitioner from the accounts under her and pay her the commission payable to her in the interest of equity and justice." 3.

Respondent No.2 filed a counter affidavit wherein it is stated that the petitioner has irregularly shown the deposits which were not at all collected by her from the depositor Sri Sheik Mohammad Ali in R.D. Account Nos. 49341, 49350 and 49566 opened at Vijayawada Polytechnic Post Office and claimed excess commission irregularly in collusion with the then counter Clerk, Sri B.Sivaiah of Vijayawada Polytechnic Sub Post Office. The said aspect has been accepted by her unconditionally in writing vide her statements dated 6.2.2015 given before the Assistant Superintendent of Post Offices, Vijayawada South Sub Division. That apart, the representation dated 9.3.2015 submitted by the petitioner has been forwarded by respondent No.2 to respondent No.3 on 23.3.2015. The said representation has been examined and rejected by the competent authority. However, without even waiting for the disposal of the representation by the competent authority, the petitioner approached this Court and filed the present Writ Petition.

In view of the fact that the representation has already been rejected, no further cause would survive in the Writ Petition. 5.

Accordingly, the Writ Petition is dismissed.

Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
