HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.994 OF 2017 ORDER:
This Writ Petition, under Article 226 of the Constitution of India, is filed by the petitioner seeking to declare the inaction of the respondents in conducting survey and demarcation in respect of lands in survey Nos.60/5 and 60/16 of Mallaram Village, Mudigonda Mandal, Khammam District, as illegal and arbitrary. Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for Revenue for respondents. With their consent, the Writ Petition is disposed of at the stage of admission itself.
The main grievance of the petitioner in this writ petition is that he submitted representations on 19.08.2015 and 04.01.2016 for conducting survey and demarcation of lands in survey Nos.60/5 and 60/16 wherein notices were issued to all the concerned by the Tahasildar on 4.02.2015 and 09.02.2015, however, till date no orders are passed. Hence, he prays for issuing appropriate direction to the respondents to conduct survey at the earliest.
Learned AGP would submit that the 4th respondent may be directed to consider the request of the petitioner for conducting survey, in accordance with law.
Having regard to the rival submissions made and since the notices were issued in the month of February, 2015, the Writ Petition is disposed of directing the 4th respondent-Tahasildar to
consider the application made by the petitioner for conducting survey in respect of lands in survey Nos.60/5 and 60/16 of Mallaram Village, Mudigonda Mandal, Khammam District, and pass appropriate orders after hearing the petitioner and other aggrieved persons, if any, in accordance with law, as early as possible, preferably within a period of four weeks from the date of receipt of a copy of this order.
