THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION NO.7319 OF 2016

O R D E R

The prayer of the petitioner in this case is as under: 'The Hon'ble Court may be pleased to issue a writ order or direction more particularly one in the nature of writ of mandamus declaring the inaction of the respondent no. 2 & 3 as arbitrary, illegal and violation of Article 14, 21 and 19(1) (g) of Constitution of India consequently direct the respondents to collect the road tax and; issue fitness certificate in respect of vehicle i.e., water tanker bearing No. AP 05 V 7489 and pass such other order or orders in the interest of justice.' Despite the matter being adjourned to enable the learned Government Pleader to get instructions, he fairly states that he was unable to do so. As the petitioner's application dated 21.01.2016 is pending consideration before the Road Transport Authorities, the second and third respondents, this Court deems it unnecessary to entertain this writ petition for adjudication on merits at this stage.

The writ petition is accordingly disposed of directing respondents 2 and 3 to consider the petitioner's application dated 21.01.2016 and take appropriate action thereon in accordance with rules. In the event the petitioner's request for collection of road tax and issuance of fitness certificate is rejected, the reasons therefor shall be recorded and duly communicated to him. This exercise shall be completely expeditiously and in any event, not later than three days from the date of receipt of a copy of this order. Pending miscellaneous petitions shall stand closed. No order as to costs.
