HON'BLE SRI JUSTICE S.V.BHATT W.P. No.22468 OF 2017 ORDER:

The petitioners pray for the following relief: "...Writ of Mandamus declaring the action of respondents 4 to 6 in attempting to dispossess the petitioners from their respective plots admeasuring each Ac.0.02 cents in Sy.No.43-2A1, 2A2, 2B, 42-1, 36-2, 44-1A to 1E, 50-2, 50-2A, 2C situated at Kotnuru village, Hindupur, Anantapuram district and also trying to assign the very same plots to third parties without issuing any notice, without following any procedure and without affording any opportunity as illegal and arbitrary and consequently direct respondents 2 to 4 not to dispossess the petitioners from the above house plots in question and not to assign the very same plots in favour of any third parties ...."

The Assistant Government Pleader, on instructions, admits that pattas in fact, have been issued, but a few of the petitioners have not occupied the plots or houses.

After perusing the material available on record, this Court is satisfied that the writ petition can be disposed of by this order: The respondents, if circumstances warrant either for cancellation of house site pattas or to dispossess the petitioners, will follow the procedure in accordance with law.

The writ petition is disposed of accordingly. No order as to costs.
