This Writ Petition is filed seeking a mandamus to declare the action of the 3rd respondent Joint Sub-Registrar-VI, in refusing to receive the deeds of conveyance presented by the petitioner for registration of Flat No. 101, 1st Floor, "SANKALP ARCADE" with built up area of 1115 square feet along with undivided share of land admeasuring 50 square yards constructed over plot No. 24, Survey No. 57/A/1 to 6 situated at Shamshiguda Village, Kukatpally Mandal, Medchal-Malkajgiri District, without assigning any reasons, as illegal, arbitrary and violative of the principles of natural justice.
The case of the petitioner is that he is the lawful owner and possessor of the subject land having purchased the same through the registered sale deed dated 17.03.2003. Thereafter, he obtained permission to construct a building therein vide permit dated 11.04.2016 and completed the same strictly in accordance with the sanctioned plan under the name and style of "Sankalp Arcade". While the things stood thus, it is the further case of the petitioner that as he wanted to sell the property, he approached the 3rd respondent for registration of the document on 22.08.2018, but however, the 3rd respondent orally refused to receive the same without assigning any reasons. Hence, the Writ Petition. Heard learned counsel for the petitioner as well as learned Government Pleader for Revenue (Telangana).
Having regard to the facts and circumstances of the case, the Writ Petition is disposed of directing the 3rd respondent Joint Sub-
Registrar-VI to receive the document that may be submitted by the petitioner for registration, if the same is in accordance with law. If the 3rd respondent does not wish to register the document, he shall return the same, duly assigning the reasons therefor, as early as possible, preferably within a period of four weeks from today, after giving an opportunity of hearing to the petitioner and all the parties concerned. No costs.
Consequently, the miscellaneous Applications, if any shall stand disposed of.
