HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.31211 OF 2018 ORDER:

The present writ petition came to be filed seeking to declare the action of the 3rd respondent-Joint Sub Registrar-6, in refusing to receive any deeds of conveyance presented by the petitioner for registration in respect of Flat No.401, 4th Floor, Sankalp Arcade with built-up area of 1115 sq. feet along with undivided share of land admeasuring 50 sq. yards (out of total land 393 sq. yards) constructed over plot bearing No.24, situated at Sy.No.57/A/1 to 6 of Shamshiguda Village, Kukatpally Mandal, Medchal-Malkajgiri District, without assigning any reasons, as illegal and arbitrary.

The grievance of the petitioner is that he is the lawful owner and possessor of the above said flat having purchased the same through a registered sale deed dated 17.3.2003 and since then the petitioner has been in continuous possession and enjoyment of the same by paying all the taxes to the concerned departments. While things stood thus, due to personal necessities, the petitioner wants to sell the subject property. As such, he approached the 3rd respondent, for registration of the same by paying the requisite stamp duty. But the 3rd respondent, orally refused to receive the same, without assigning any reasons. Challenging the same, the present writ petition, came to be filed.

Having regard to the facts and circumstances of the case, the writ petition is disposed of directing the 3rd respondent-Joint Sub Registrar-6, to receive the documents for registration, if they are in accordance with the law. If the 3rd respondent-Joint Sub Registrar-6, is not intending to register the documents presented by the petitioner for registration, the 3rd respondent-Joint Sub Registrar-6, shall return the same assigning reasons, as early as possible, preferably within a period of two to four

weeks from today, by giving reasonable opportunity of hearing to the petitioner and all the concerned.

With the above direction, the writ petition is disposed of. No order as to costs. As a sequel to disposal of the writ petition, WP.M.Ps if any pending shall stand closed.
