THE HONOURABLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.31260 of 2018 ORDER:
The grievance of the petitioner in the present Writ Petition is without recourse to the due process of law and without paying any compensation, the respondent-authorities are trying to acquire the property of the petitioner.
Learned Counsel for the petitioner submits that the respondent-authorities are offering T.D.Rs.
It is submitted by the learned Standing Counsel for the respondent-Municipal Corporation that there is an option available to the petitioner to receive the TDRs from the Corporation and therefore, if the petitioner is agreeable for the TDRs., further proceedings can be initiated by the respondent-Municipal Corporation; and, if the petitioner is not agreeable for the TDRs., the authorities will proceed in accordance with law for acquiring the property under the provisions of the relevant statute. Recording the above submissions, the Writ Petition stands disposed of. The said exercise shall be completed within a period of two months from the date of receipt of a copy of this Order. There shall be no order as to costs.
Miscellaneous Petitions pending consideration, if any, in this Writ Petition shall stand closed.
