THE HON'BLE SRI JUSTICE K.C. BHANU WRIT PETITION No. 14566 of 2015 ORDER:

This Writ Petition is filed seeking issuance of Writ of Mandamus declaring the action of the 2nd respondent in not dealing with the appeal dated 01.05.2015 and the stay petition filed by the petitioners under Section 89 of A.P. Education Act,1982 (for short "the Act") against the orders passed by the 4th respondent vide Proceedings Rc.No.7742/263/D3/2011, dated 09.04.2015, as illegal and arbitrary and further to direct the 2nd respondent to dispose of the appeal expeditiously.

An innocuous prayer has been sought by the petitioners. In view of the fact that the appeal is pending before the 2nd respondent, petitioners cannot be permitted to prosecute two parallel proceedings for the same cause of action. The Writ Petition is therefore disposed of, directing the 2nd respondent to dispose of the said appeal within a period of two (02) weeks from the date of receipt of this order by giving an opportunity to all the parties concerned. There shall be no order as to costs.
