HON'BLE SRI JUSTICE S. RAVI KUMAR TRANSFER C.M.P.No.347 of 2016 ORDER:

This petition is filed to transfer F.C.O.P.No.24 of 2016 from the file of Family Court, Nellore, to any Court at Sanga Reddy, in the interests of justice.

2. Wife filed this petition. According to her affidavit, her marriage with respondent was performed on 29.07.1998 as per Hindu rites and custom and during their wedlock two daughters were blessed, who are now aged about 11 years and one year respectively. She stated that due to harassment she was constrained to lodge F.I.R., which was subsequently registered as C.C.No.280 of 2014 before Judicial Magistrate of First Class (Prohibition and Excise), Sanga Reddy, Medak District, which was ended in conviction. She stated that respondent filed appeal before District Court, Medak at Sanga Reddy, and the same is pending.

She further stated that she filed M.C.No.33 of 2011 and the same was partly allowed and respondent filed revision against the order of maintenance and the same is also pending before District Court, Medak at Sanga Reddy. She stated that respondent in order to harass her filed F.C.O.P.No.24 of 2016 before Family Court, Nellore, for divorce and that she has no one at Nellore and it is difficult for her being a lady to travel from her place of residence to Nellore. She stated as some

proceedings are pending at Sanga Reddy, her request for transfer of F.C.O.P.No.24 of 2016 from Nellore to Sanga Reddy, may be considered, for which no prejudice would be caused to respondent as he is already contesting the cases at Sanga Reddy.

3. This Court permitted petitioner to take personal notice to respondent through registered post with acknowledgment due. Notice sent by Court and also personal notice issued by petitioner are served on respondent.

In spite of service respondent neither appeared in person nor through any advocate.

4. Heard advocate for petitioner.

5. Considering the reasons stated in the affidavit, F.C.O.P.No.24 of 2016 is withdrawn from Family Court, Nellore, and transferred to Senior Civil Judge, Sanga Reddy at Medak, for disposal in accordance with law, as prayed for.

6. Transfer C.M.P. is ordered accordingly.

7. Miscellaneous petitions pending, if any, shall stand closed.
