Heard Sri V. Subrahmanyam for petitioners, learned Assistant Government Pleader for Respondents 1 to 4, and Sri Rajagopallavan Tayi for Respondent No.5.

The petitioner challenges the order passed by 3rd Respondent in Proceedings No.D/ 1228/ 2015, dated 04.07.2016 as illegal, violative of principles of natural justice and constitutional. 3.
This Court has directed Respondent No.3 to produce the original record of Proceedings No. D/ 1228/ 2015, dated 04.07.2016. The file is produced for examination by this Court. The counsel appearing for respondents, after going through the perfunctory manner in which the request of Respondent No.5 is taken up under the A.P. Rights in Land and Pattadar Pass Books, 1971 and seeing the difficulty to sustain the order dated 04.07.2016, consents to setting aside the order and remit the matter to 3rd Respondent.

The statement of the learned counsel is placed on record. The impugned order dated 04.07.2016 is set aside. The matter is remitted to 3rd respondent for fresh consideration and disposal in accordance with law.

The writ petition is accordingly allowed. As a sequel, the miscellaneous petitions pending, if any, shall stand closed. There shall be no order as to costs.
