THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.3250 of 2016 ORDER:

The prayer of the petitioner in this case is as under: "For the reasons stated in the accompanying affidavit, it is prayed that, this Hon'ble Court may be pleased to issue appropriate writ, orders or directions, preferably in the nature of writ of Mandamus, declaring the action of the 4th respondent in seizing the documents i.e document No.1478 of 2013 and document No.196 of 2009 of the petitioner is illegal, arbitrary and pass such other order or orders as this Hon'ble Court deems fit and proper in the circumstances of case and in the interest of justice, otherwise we shall be put to grave hardship."

The Sub-Inspector of Police, Vijayawada II Town Police Station, Krishna District, filed a counter-affidavit stating that upon seizing the registered documents bearing Nos.1478 of 2013 and 196 of 2009 in relation to Crime No.480 of 2015 which was registered on the file of II Town Police Station, Vijayawada City, under Sections 384, 420, 474 and 506 I.P.C. read with Section 34 I.P.C., the police authorities deposited the said documents before the learned Chief Metropolitan Magistrate, Vijayawada, vide C.F.No.1496 of 2015. In the light of the afore-stated development, it is for the petitioner to workout her remedies in accordance with law insofar as the seized documents are concerned.

Reserving liberty to the petitioner to do so, the writ petition is closed. Pending miscellaneous petitions, if any, shall also stand closed. No order as to costs.
