Heard learned counsel for the petitioner and learned standing counsel for the respondents.
2. The petitioner is a licensee of cycle/scooter stand of Thallada bus station and the period of licence expired on 03.05.2015. He complied with the conditions of licence all these years from 2011. While so, the 3rd respondent issued a tender notification on 16.04.2015 inviting tenders for allotment of shops, telephone booths, canteen including cycle/scooter stand. The petitioner submitted a representation on 27.04.2015 to the 3rd respondent to extend the lease period for another two years on enhancement of rent. When this Court put a question to the learned counsel for the petitioner whether the earlier licence contains the clause for renewal, the learned counsel for the petitioner fairly submitted that there is no clause for renewal of the licence.
In that view of the matter, there is no provision for consideration of the representation made by the petitioner on 27.04.2015 for extension of the lease when there is no provision for continuance of the licence beyond the period of licence granted earlier. The action of the 3rd respondent in issuing the tender notification cannot be found fault with. In the above circumstances, this Court sees no reason to entertain the writ petition.
3. Accordingly, the Writ Petition is dismissed at the admission stage. Miscellaneous petitions, if any, pending in the writ petition shall stand closed. There shall be no order as to costs.
