This writ petition is filed assailing the Proceedings dated 20.03.2018 issued by the respondent No.2 stating that the petitioner has indulged in theft of electricity under Section 135 of the Electricity Act, 2003 (for short 'the Act'), and that his service connection was disconnected on 08.03.2018 and civil liability is provisionally assessed at Rs.4,25,176/ - and the petitioner should pay the same in order to restore the service connection.
In similar cases, this court has directed restoration of electricity supply on payment of 50% of demanded amount and power supply will not be disconnected till civil liability is determined under Section 154(5) of the Act.
Admittedly, in the instant case, the petitioner has paid 50% of the demanded amount.
In that view of the matter, the writ petition is disposed of directing the respondents to restore electricity supply to the petitioner's service connection and refer the matter to the Special Court constituted under Section 154(5) of the Act for determination of his civil liability, and till such determination, the electricity service connection of the petitioner shall not be disconnected. No costs.
Miscellaneous Petitions, if any, pending in this writ petition shall stand closed.
