HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.28596 OF 2017 ORDER:

Heard learned counsel for the petitioners and the learned Government Pleader for respondents.

The first petitioner states that he is the owner of Auto Rickshaws bearing Nos.AP 04 TX 1945 and AP 04 TX 1921. While so, on 07.08.2017, the said vehicles were seized by the third respondent under the Panchanama on the allegation that there was illegal transportation of the goods without valid documents. The said vehicles were seized along with ten plastic bags of 4.50 Quintals of rice and 16 plastic bags of 7.20 Quintals of rice. The seized rice was kept in MLS Point, Mydukur, for safe custody. The petitioners filed an application before the second respondent for release of the vehicles and when no orders are passed, the present writ petition is filed.

Since the petitioners claim that they eke out their livelihood on running the Auto Rickshaws, the second respondent shall consider the application of the petitioners for release of the vehicles and release them subject to his satisfaction by imposing necessary conditions, within a period of one week from the date of receipt of a copy of this order. The writ petition is accordingly disposed of.
