THE HONOURABLE SRI JUSTICE M.S.RAMACHANDRA RAO CC.No.2203 of 2015 ORDER :

This Contempt Case is filed alleging willful disobedience of the order dt.23.01.2015 in CRP.No.5241 of 2013 passed by this Court.

While dismissing the Revision filed by respondents, this Court held that respondent shall vacate the R.C.C. Schedule premises by 30.04.2015 subject to certain conditions, and that if such conditions are not fulfilled, they are liable to evicted from the R.C.C. Schedule premises forthwith.

The counsel for petitioner herein contends that respondents have not complied with the conditions such as filing of undertaking as directed in the said order and also did not pay the rents as directed therein and therefore, they have committed Contempt of Court.

4. I do not agree with the said submissions. 5.

The order in the Revision itself states that if the undertaking is not filed or if the arrears of rents are not paid, the respondents would become liable to be evicted forthwith.

Therefore, it is open to petitioner to file an

application for execution of the order of eviction against the respondents and it cannot be contended that there is any willful disobedience of the order passed by the Court by respondent nos.1 and 2.

7. Accordingly, the Contempt Case is dismissed. No order as to costs.
