HONOURABLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.31220 OF 2018 ORDER :

This writ petition is filed challenging the action of the 1st respondent in registering crime Nos.641/2018 and 648/2018, on the file of Madhapur Police Station, Cyberabad, Hyderabad, though the said two crimes are relating to Crime No.607/2018 and investigation in the said Crime is pending. The writ petitioner already filed Crl.P.Nos.9512/2018 and 9436/2018 for quashing of Crime Nos.641/2018 and 648/2018 and this Court disposed of those criminal petitions directing the respondent police to follow procedure laid down under Section 41A of the Code of Criminal Procedure and guidelines prescribed in Arneshkumar's case (2014) 8 SCC 273.

Though the petitioner filed this writ petition seeking to declare registration of the said crimes as illegal, simultaneously he also filed the above criminal petitions for quashing of Crime Nos.641/2018 and 648/2018.

Learned counsel for the petitioner states that subsequent to filing of writ petition, criminal petitions are filed, since the respondents, instead of taking the subsequent complaints as 161 statements registered FIR Nos.641 and 648 of 2018. Since the said plea was also available when criminal petitions were disposed of, I am not inclined to entertain the writ petition.

Accordingly, the writ petition is dismissed. No order as to costs.

As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
