HON'BLE SRI JUSTICE C.PRAVEEN KUMAR CRIMINAL REVISION CASE No.2526 of 2016 ORDER:
The present revision is filed under Sections 397 and 401 of the Code of Criminal Procedure (Cr.P.C.), questioning the order dated 01.07.2016 passed in Crl.M.P.No.387 of 2015 in C.C.No.36 of 2014 on the file of II Additional Special Judge for CBI Cases, Visakhapatnam, wherein and where under the petition filed to discharge the accused for the offences punishable under Section 120-B read with Section 420 of IPC and Section 13(2) read with Section 13(1)(d) of Prevention of Corruption Act was rejected.
Though the present revision is filed questioning the order refusing to discharge, learned counsel for the petitioner restricts his prayer seeking dispensation of the presence of petitioner, during the course of the trial. The learned Standing Counsel for CBI submits that since there is no dispute with regard to the identity, his presence may not be necessary on every date of adjournment. Having regard to the facts and circumstances of the case and since there is no dispute with regard to the identity of the petitioner, his presence in C.C.No.36 of 2014 on the file of II Additional Special Judge for CBI Cases, Visakhapatnam, is hereby dispensed with except on the dates when his presence is specifically required by the Court. Further, the petitioner/ A2 shall not dispute the cross examination done by his counsel on the dates of his absence.
With the above direction, the Criminal Revision Case is disposed of.
