HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.31152 OF 2018 ORDER:

The present writ petition came to be filed seeking to declare the action of the respondents 2 and 3, in not releasing the registered sale deed document bearing No.P-1106/2018, dated 13.6.2018, executed in favour of the petitioner, by his vendors without any valid reasons, as illegal and arbitrary.

When the matter is taken up for hearing, learned Government Pleader for Revenue, placed on record, the written instructions, wherein it is stated that while the impugned document is pending for registration, one Narra Srinivasa Rao lodged a complaint dated 15.6.2018, before the 2nd respondent and the Circle Inspector of Police, Narasaraopet against the executants of the document Valluru Veera Sekhara Rao and A. Srimannarayana stating that they have played fraud on the schedule property mentioned in the impugned document. It is also stated that the impugned document is still pending, in view of the criminal case against Valluru Veera Sekhara Rao and A. Srimannarayana who fraudulently surrendered the lease without having any authority whatsoever to sell the property in favour of the petitioner.

Though the impugned document was presented before the respondents 2 and 3 on 13.6.2018, the respondents 2 and 3 failed to take any steps either to register or return the same so far. If really there is any criminal case or civil case pending, the respondents 2 and 3, ought to have returned the same giving valid reasons for not registering the document, but, without doing so, the respondents 2 and 3 cannot keep the impugned document pending for months together. Having regard to the facts and circumstances of the case, the writ petition is disposed of directing the respondents 2 and 3, to pass appropriate orders on the document bearing No.P-1106/2018, dated

13.6.2018, in accordance with law, and communicate the same to the petitioner, as early as possible, preferably within a period of three weeks from the date of receipt of copy of this order, by giving reasonable opportunity of hearing to the petitioner and all the concerned. With the above direction, the writ petition is disposed of. No order as to costs. As a sequel to disposal of the writ petition, WP.M.Ps if any pending shall stand closed.
