HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.5566 of 2017 ORDER:

This petition is filed for a writ of Mandamus declaring the action of respondents 3 & 4 in seeking to dispossess petitioners from their land in Survey No.301, 302/4, situated at Allur Village, Kothapatnam Mandal, Prakasham District, without issuing any notice and without following any due process of law, as illegal and arbitrary and for a consequential direction to the respondents not to dispossess the petitioners from the subject land. Learned counsel for the petitioners submits that the Government having recognized the petitioners' long possession over the subject lands gave provisional assignment orders.

Learned Assistant Government Pleader for Revenue submits that steps are being taken to issue show cause notice to the petitioners and that they would follow due procedure in case the respondent authorities take action against the petitioners.

In view of the above, the writ petition is disposed of directing the respondents not to evict the petitioners from the subject lands, without following due process of law. No order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending shall stand closed.
