THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY CRIMINAL PETITION No. 9458 OF 2018 ORDER:

This petition is filed questioning the inaction of Judicial I Class Magistrate at Alair (for short, 'the Court below') in processing C.F.SR.No. 2848 of 2017 pending on its file since November, 2017.

The petitioner filed a private complaint under Section 200 of Cr.P.C. against respondent Nos. 2 and 3 on the file of the Court below for the offences punishable under Sections 420, 447, 323, 504 and 506 of IPC in the month of November, 2017, and since then, it is pending at the same stage. The Court below neither recorded sworn statement of the complainant and the witnesses nor referred the matter to police by exercising power under Section 156 (3) of Cr.P.C.

Keeping the complaint pending for such a long period tarnishes the image of the judiciary, more particularly for causing such an abnormal delay in the proceedings to be taken by the Court below and thereby presiding officers are becoming privies to the delay. To avoid further delay, the Court below is directed to complete the processing of C.F.SR.No. 2848 of 2017 within a week from the date of receipt of a copy of this order.

The criminal petition is accordingly allowed. Pending miscellaneous petitions, if any, in this criminal petition shall stand closed in consequence. _____________________________ Date: 05-09-2018.
