HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.12095 OF 2013

O R D E R

This writ petition is filed for a writ of mandamus declaring the action of the respondents 2 to 4 in not acting upon the complaints given by the petitioner and not taking necessary steps, as illegal and arbitrary. (b) Directing the 4th respondent, Station House Officer to register the FIR and take steps under the provisions of IPC against 5th respondent and others.

(c) Consequently direct respondents 2 to 3 to cause necessary enquiry under the provisions of Registration Act 1908 on the objections of the petitioner dated 15.03.2013 and 18.03.2013 and pass orders refusing to register the document pertaining to the premises bearing No.7-6-222/1 corresponding to the old number 6-5-6/2/2 and 6-5-6/2/3, comprising an extent of 0.5 gunts and 63 sq.yards situated at Ashok Nagar, near Jambigadde locality of Jagtial town and Mandal, Karimnagar District, as illegal and arbitrary and for a consequential direction to the 3rd respondent not to release the sale deed pertaining to the above mentioned property. Heard the learned counsel for the petitioner and the learned counsel appearing for the 5th respondent.

Both the counsel stated that the 3rd respondent has refused to register the documents presented by the 5th respondent and his vendees, as such, the cause in the writ petition does not survive for adjudication. Recording the aforesaid submission, the writ petition is dismissed as infructuous. There shall be no order as to costs. As a sequel, miscellaneous petitions pending if any, shall stand closed.
