HON'BLE SRI JUSTICE U.DURGA PRASAD RAO Writ Petition No.7037 of 2011 ORDER:

This Writ Petition is filed challenging the inaction of the respondents i.e, they have not completed the investigation and filed charge sheet in FIR No.42/2010 of Nandikotkuru Police Station, Kurnool District, though statutory period was over in filing the charge sheet. 2) The 4th respondent filed counter and opposed the petition. 3) When the matter came up for hearing today, referring to Para 4 of the counter filed by 4th respondent, learned Government Pleader for Home would submit that in the said counter it is clearly mentioned that after completion of investigation, final report under Section 173 Cr.P.C was filed before the Judicial Magistrate of First Class, Nandikotkur, referring the case as false and thus prayed to close the writ petition.

4) Learned counsel for petitioner has not objected for it. 5) In view of the above submission, this Writ Petition is closed as infructuous. No costs.
