THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.4946 OF 2016 ORDER:

This petition is filed by the petitioner-owner of the vehicle under Section 482 Cr.P.C. seeking to relax the conditions imposed in Crl.R.P.No.291 of 2015 by the Metropolitan Sessions Judge, Hyderabad vide order dated 9.2.2016.

The petitioner filed Crl.M.P.No.3188 of 2015 in Crime No.485 of 2015 before the IX Additional Chief Metropolitan Magistrate, Hyderabad for return of property viz., motor cycle seized in the above Crime. The learned Magistrate dismissed the said Crl.M.P. Aggrieved by the same, the petitioner filed the above Crl.R.P. The learned Metropolitan Sessions Judge while ordering return of the vehicle for the interim custody of the petitioner imposed a condition directing him to furnish a self bond for a sum of Rs.10,000/- with one surety for the like sum. Aggrieved by the said condition, the petitioner filed this petition.

Heard and perused the material available on record. Considering the facts and circumstances of the case, the above condition imposed by the learned Metropolitan Sessions Judge directing the petitioner to furnish a self bond for a sum of Rs.10,000/- with one surety for the like sum, is modified to that of a self bond for a sum of Rs.5,000/- (Rupees Five Thousand only) with one surety for the like sum. Rest of the conditions imposed in the order impugned herein shall remain.

Accordingly, the Criminal Petition is disposed of.

Consequently, miscellaneous petitions pending, if any, shall stand closed.
