This writ petition is filed against the proceedings in CCLA's Procs.No.V.S.I.(3)/1065/2017, dated 24-08-2017, wherein the petitioner was suspended pending enquiry. Learned counsel for the petitioner submits that at the first instance, the District Collector surrendered the petitioner by issuing proceedings dated 04-08-2017 and since the petitioner filed W.P.No.26509 of 2017 before this Court and this Court by order dated 08-08-2017 suspended the said order. Now the 2nd respondent issued impugned proceedings. In fact the Collector has suspended V.R.O. vide proceedings dated 04-08-2017 and the Collector thought it fit to suspend the petitioner. As such the impugned order suspending the petitioner is not warranted.
On the other hand, learned Government Pleader for Services submits that since the 2nd respondent found that serious allegations are made against the petitioner issued impugned proceedings suspending the petitioner pending enquiry.
Truth or otherwise of allegations cannot be gone into at this stage. In this case, admittedly the 2nd respondent by referring allegations made against the petitioner thought it fit to suspend the petitioner pending enquiry. Whether the petitioner alone is responsible or V.R.O. also is responsible will have to be dealt with in the enquiry, which is pending. But
at this stage, all such aspects cannot be decided without conducting enquiry and this Court will not ordinarily interdict the order of suspension pending enquiry, as it is not a punishment. In view of the same, I do not see any reason to entertain the writ petition.
Accordingly, the writ petition is dismissed. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
