THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR CRIMINAL PETITION No.3276 of 2015 ORDER:

The present application is filed under Section 438 Cr.P.C., seeking release in the event of the arrest of the petitioner in an unregistered crime to be registered on the basis of a report given by one Smt.Ganapathi Venkata Rama Devi. Learned Pubilc Prosecutor, on instructions, submits that no crime is registered till now.

Having regard to the circumstances stated above, the investigating agency shall follow the Judgment of the Apex Court in Arnesh Kumar v. State of Bihar and another and Section 41 of Cr.P.C., if any crime is registered pursuant to the report given by Smt.Ganapathi Venkata Rama Devei relating to matrimonial disputes.
