THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL REVISION CASE No.1354 OF 2016 ORDER:
This revision is preferred challenging the docket order, dated 25.6.2012, passed in P.R.C.No.19 of 2011 on the file of the Judicial Magistrate of First Class, Palamaner, Chittoor District, wherein the learned Magistrate issued N.B.W. against petitioner/ A-1.
2. The offences alleged against the petitioner/A-1 are punishable under Section 9(B) 1(b) of the Explosives Act, 1984 and Section 5(a) & (b) of the Explosive Substances Act, 1908.
3. Learned counsel for the petitioner submitted before this Court that the petitioner is ready to face the trial and he will not flee from the hands of justice.
4. Having heard the learned counsel for the petitioner and the learned Additional Public Prosecutor and having perused the material available on record, this Court is of the view that the revision can be disposed of with the following directions :
The petitioner/A-1 is directed to appear before the Court concerned and file a petition to recall the warrant issued against him and on such filing of a petition, the trial Court is directed to recall the warrant on the same day on his execution of bond for a sum of Rs.10,000/- (Rupees ten thousand only) with one surety for a like sum and further, the petitioner is directed to appear before the trial Court regularly.
5. Accordingly, the Criminal Revision Case is disposed of.
6. Miscellaneous petitions pending, if any, in this Criminal Revision Case shall stand closed.
