THE HON'BLE SRI JUSTICE SANJAY KUMAR CONTEMPT CASE NO.767 OF 2016

O R D E R

This contempt case was instituted alleging willful disobedience to the order dated 06.10.2015 passed by this Court in W.P.No.28566 of 2008. By the said order, this Court directed the Andhra Pradesh Social Welfare Residential Educational Institution Society, Hyderabad, to consider the petitioner's representation dated 19.08.2014 in accordance with law and pass appropriate reasoned orders thereon after giving an opportunity of hearing to the petitioner. Sri P.V.Ramana, learned counsel for the respondent, the Secretary of the Society, would state that pursuant to the aforestated order passed by this Court, a speaking order was passed on 27.08.2016 informing the petitioner that her request would be examined after the final outcome of W.P.No.27846 of 2012 filed by her.

It is now represented by Sri Jayanthi Sekhar, learned counsel representing Sri Venkateshwar Varanasi, learned counsel for the petitioner, that W.P.No.27846 of 2012 was allowed by this Court vide order dated 02.03.2017.

Sri P.V.Ramana, learned counsel, would however inform this Court a writ appeal in W.A.No.863 of 2017 has been filed against the aforestated order dated 02.03.2017 passed in W.P.No.27846 of 2012. In any event, in so far as the order dated 06.10.2015 passed by this Court in W.P.No.28566 of 2008 is concerned, the same stood complied with once the Society considered the petitioner's representation as directed and passed a speaking order. disobedience, much less willful disobedience, is made out warranting exercise of contempt jurisdiction.

The contempt case is accordingly dismissed. The petitioner is at liberty to work out her remedies after disposal of W.A.No.863 of 2017. No order as to costs.
