HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.18414 of 2016 ORDER:

This writ petition is filed seeking issuance of Mandamus declaring the action of the respondents in constructing the compound wall without following the sanctioned plan issued by the Gram Panchayat, since the authorities are not maintaining the construction gap between the compound wall of Theatre and School, as illegal, arbitrary, unreasonable and violative of the principles of natural justice and also contrary to the provisions of the Andhra Pradesh/Telangana Gram Panchayat Act, 1964 and Gram Panchayat Building Rules, 1968, and consequently sought a direction to the respondents not to construct the compound wall between the Theatre and the School without following due process of law.

Heard learned counsel for the petitioner as well as the learned Standing Counsel for respondent No.1, learned Government Pleader for Education (Telangana), learned Government Pleader for Revenue (Telangana) and Sri B. Narayana Reddy, the learned Assistant Solicitor General.

Though learned counsel for the petitioner raised various grounds in the writ petition, he has confined the relief to the extent of considering the representation dated

27.05.2016 made by the petitioner to respondent No.1 regarding illegal construction of compound wall, at the earliest.

While denying the various allegations made in the writ petition, the learned Standing Counsel for respondent No.1 submits that the representation of the petitioner will be dealt with in accordance with law.

In view of the above facts and circumstances and without going into the merits of the case, this writ petition is disposed of directing respondent No.1 to consider the representation dated 27.05.2016 made by the petitioner and pass appropriate orders in accordance with law, as early as possible, preferably within a period of four weeks from the date of receipt of a copy of this order. No order as to costs.

As a sequel, miscellaneous petitions pending, if any, shall stand closed.
