HON'BLE SRI JUSTICE R.KANTHA RAO Writ Petition No.33265 of 2015 ORDER:

Heard Sri Rajkumar Rudra, learned counsel appearing for the petitioner and Sri N. Vasudeva Reddy, learned Standing Counsel for the respondents-Corporation.

2. The petitioner was appointed as a driver in the year 1998 in the Corporation and his services were regularized with effect from 05.10.2007 in the said post. In the periodical medical examination held on 24.12.2014, he was declared unfit for the post of driver in A1 category as per the medical standards of the RTC on the ground of severe OSA. The 3rd respondent issued a letter dated 18.01.2015 informing him that as per the medical board examination, he is unfit for the post of driver in A1 category but they opined that he is fit for the alternative employment as Conductor in A2 category after necessary training. But as no alternative employment was provided by the Corporation, the petitioner filed WP No.14096 of 2015 before this court and this court disposed of the said writ petition on 02.06.

2015 directing the respondents to consider the representation of the petitioner for alternative employment. Thereafter, the petitioner was appointed as a Conductor and was directed to undergo training. It is the version of the petitioner that he studied only 8th class, having worked for a period of 16 years as driver, he lost all his knowledge and almost he became an illiterate and therefore, it is not possible for him to perform the duty of the conductor, even if he is given training. On 01.10.2015 he submitted representation to the Corporation expressing his difficulty to perform the job of the conductor and requested them to provide alternative employment as shramik/record tracer etc. or any other similar job and the said representation is pending with the respondents.

3. Under these circumstances, the writ petition is disposed of, directing the respondents to consider the representation dated 01.10.2015 submitted by the

petitioner, where under he sought alternative employment as Shramik/Record Tracer etc. and pass appropriate orders thereon, within a period of eight (8) weeks from the date of receipt of a copy of this order.
