HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY CRIMINAL PETITION No.9236 OF 2018 ORDER:

This Criminal Petition, under Section 482 of the Code of Criminal Procedure, is filed by the Petitioner/A-5 to quash the proceedings in C.C. No.96 of 2009, pending on the file of the Court of Judicial First Class Magistrate, Gooty, Anantapur District (For short, the trial Court'), registered for the offences punishable under Sections 188 and 283 of I.P.C.

During course of hearing, learned counsel for the petitioner represented that earlier Criminal Petition No.3670 of 2013 filed by A-2 and Criminal Petition No.8597 of 2018 filed by A-1 and A-3 were allowed by this Court quashing the proceedings against them in C.C. No.96 of 2009 and that as the petitioner is also similarly situated person, the proceedings against him may be quashed.

Since the controversy is squarely covered by the orders of this Court in Criminal Petition Nos.3670 of 2013 and 8597 of 2018 respectively, this Criminal Petition is allowed quashing the proceedings against the Petitioner/A-5 in C.C. No.96 of 2009 pending on the file of the Court of Judicial First Class Magistrate, Gooty, Anantapur District, in terms of the orders passed by this Court in Criminal Petition Nos.3670 of 2013 and 8597 of 2018.

As a sequel, miscellaneous petitions, if any pending, shall stand closed.
