THE HON'BLE SRI JUSTICE S.V.BHATT W.P.No.16010 of 2013 ORDER:

The petitioner prays for Mandamus declaring the action of respondents in issuing bills for connection bearing No.CAN 054103814 towards water cess inspite of disconnection of water supply in the year 2008 and demanding sewer cess at commercial rates particularly without c onsidering the representation dated 05-06-2013 and threatening to disconnect sewer line as illegal and arbitrary.

On 07-06-2013, the following interim order was passed :- " There shall be interim stay on condition of the petitioner depositing 25% of the amount pursuant to the notice, dated 18-03-2010 within a period of two weeks from the date of the receipt of a copy of the order. In default, this order stands annulled."

The counsel for petitioner submits that the condition has been complied with. It is submitted that if the representation still remains unattended, appropriate direction can be issued to respondents to dispose of representation, dated 05-06-2013. In spite of interim order, the respondents neither filed counter nor any instructions are given to the Standing Counsel. Without expressing any view on the merits, I am satisfied the writ petition can be disposed of by directing the 2nd

respondent to dispose of representation, dated 05-06-2013 within two months from the date of receipt of a copy of this order. Till a decision on the representation is taken and c ommunicated to the petitioner, the interim order, dated 07-06-2013 is directed to be maintained.

Accordingly, the writ petition is disposed of. No order as to costs.
