ORDER:

This writ petition is filed for a mandamus to set aside proceedings, dated 24.12.2009, of respondent No.1, whereby he has suspended the petitioner's fair price shop authorization.

At the hearing, the learned Assistant Government Pleader for Civil Supplies (AP) submitted that in view of the interim order passed by this Court on 31.12.2009, the petitioner is being continued as the fair price shop dealer. He has, however, submitted that so far, enquiry has not been completed and a final order has not been passed.

A perusal of the aforesaid interim order shows that this Court, while directing the respondents to continue the petitioner as the fair price shop dealer, further directed respondent No.1 to complete the enquiry within eight weeks. In the face of this unequivocal direction, this Court is unable to understand as to why respondent No.1 has not completed the enquiry and passed final order.

Therefore, respondent No.1 is directed to complete the enquiry and pass a final order within a period of three months from the date of receipt of a copy of this order.

Subject to the above direction, the Writ Petition is disposed of. As a sequel to disposal of the writ petition, W.P.M.P.No.37420 of 2009 filed by the petitioner for interim relief shall stand disposed of as infructuous. _________________________ C.V.NAGARJUNA REDDY, J 30th September, 2015 GHN
