THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.40023 of 2016 ORDER:

This writ petition under Article 226 of Constitution of India is filed seeking to declare the action of respondents 1 to 4 in not taking any action on the petitioner's representation, dated 15.10.2016, as illegal and arbitrary.

Heard and perused the material available on record. The grievance of the petitioner is that the accused person, who is having criminal dishonest intention and induced the petitioner and others to invest huge amounts in his business by assuring the petitioner and others that they will get huge profits and believing his version, the petitioner along with others invested huge amounts, but the accused dragged to pay the investment amount on one pretext or the other and the said person, having a dishonest intention to cheat the petitioner and others, failed to return back the amount. Aggrieved by the same, the petitioner lodged a complaint on 15.10.2016 to the 4th respondent, but the 4th respondent is not registering the same.

Considering the grievance of the petitioner, the 4th respondent is directed to register a case against the accused person, if the complaint lodged by the petitioner, dated 15.10.2016, discloses any cognizable offence and investigate into the same and file a final report if any. If the petitioner is aggrieved by the action of the 4th respondent, he is at liberty to approach the superior officer of the 4th respondent and also to approach the concerned Court by invoking provision under Section 200 Cr.P.C.

Accordingly, the Writ Petition is disposed of. No costs. Pending Miscellaneous Petitions, if any, shall stand closed. ___________________ RAJA ELANGO,J Date: 21st November, 2016 KL
