ORDER
The present criminal revision case is directed against the order dated 06.01.2016 passed in Crl.M.P.No.6027 of 2015 in C.C.No.296 of 2013 by the learned IV Additional Judicial Magistrate of First Class, Tirupati.
2. Heard and perused the material on record.
3. The petitioner/A1 is involved in C.C.No.296 of 2013 on the file of IV Additional Judicial Magistrate of First Class, Tirupati, registered for the offences punishable under Sections 498-A, 420, 506 IPC and under Sections 3 and 4 of Dowry Prohibition Act. Petitioner states that even though there is no order from the Court for seizure of his passport, the police seized his passport and sent the same to the Regional Passport Officer for impounding. Hence, he filed the impugned application seeking to return his passport and permit him to depart India to enable him to go to USA. By the order impugned, the trial Court dismissed the same. Aggrieved by the same, the present revision is filed.
4. Admittedly, this Court granted stay of all further proceedings against A4 to A7 in C.C.No.296 of 2013. Since the identity of the petitioner is not in dispute and he would be represented by his counsel before the trial Court, this Criminal Revision Case is disposed of with the following direction; The Regional Passport Officer, Hyderabad, is hereby
directed to return the passport bearing No.G4873177 dated 20.11.2007 to the petitioner and the petitioner is also permitted to go to abroad for pursuing his job on his undertaking to appear before the trial Court on the date of his examination under Section 313 Cr.P.C. and pronouncement of judgment. The petitioner is directed to represent his case though his counsel on all hearing dates except the date of his examination under Section 313 Cr.P.C. and pronouncement of judgment.
Miscellaneous Petitions, if any, pending in this revision shall stand closed.
