HONOURABLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION No. 26667 of 2015 ORDER:

Heard learned Counsel for the petitioner and learned Government Pleader for the respondents.

The petitioner was appointed as Fair Price Shop Dealer for shop No. 35 of Vitlampally village, Kalyandurg Mandal, Ananthapur District. The fair price shop of the petitioner was seized eight times on earlier occasions. It appears that on 27.4.2015 the authorization of the petitioner was suspended for a period of 90 days pending enquiry. It is the case of the petitioner that no show cause notice was issued till date despite passing the order of suspension on 27.4.2015. Challenging the said order, the present Writ Petition is filed. The impugned order of suspension contains as many as nine charges levelled against the petitioner. When the suspension order was passed based on the report dated 27.4.2015, the third respondent ought to have completed the proceedings by now.

It is the case of the petitioner that no show cause notice was issued by the third respondent till date.

The Writ Petition is disposed of. Miscellaneous petitions pending consideration if any in the Writ Petition shall stand closed in consequence. No order as to costs.
