THE HONOURABLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.31224 of 2018 ORDER:

A notice bearing No.896/1/4/ TPS/C-14/CZ/GHMC/2018, dated 18.08.2018, issued under Sections 452 (1) and 461 (1) of the GHMC Act is under challenge in the present Writ Petition. In fact, in response to the said show cause notice, the petitioner herein submitted an explanation on 20.08.2018. It is submitted by the learned Counsel for the petitioner that the provisions of law, as indicated in the show cause notice, cannot be pressed into service for taking action against the writ petitioner.

Since the petitioner herein already filed an elaborate explanation on 20.08.2018, this Court deems it appropriate to dispose of the Writ Petition, with a direction to the respondentMunicipal Corporation to consider the explanation of the petitioner and pass appropriate orders, strictly in accordance with law. Till the said exercise attains finality, there shall be no coercive action against the subject structures.

Miscellaneous Petitions pending consideration, if any, in this Writ Petition shall stand closed. There shall be no order as to costs.
