THE HON'BLE SRI JUSTICE N.BALAYOGI C.R.P. No.771 OF 2013 AND C.M.A. No.104 of 2013 COMMON ORDER:
Learned counsel for the petitioner and appellant in both the C.R.P. and C.M.A. filed a memo seeking permission of this Court to withdraw the cases with liberty to file fresh amendment petition before the trial Court as per law and meanwhile, sought for extension of interim stay granted by this Court in C.M.A.M.P.No.232 of 2013 in C.M.A.No.104 of 2013, dated 13.02.2013. Learned counsel for the second respondent conceded no objection, if this Court extends the interim relief till 11.12.2017.

Permission is accorded and both the C.R.P. and the C.M.A. are dismissed as withdrawn. The interim injunction granted in C.M.A.M.P.No.232 of 2013 in C.M.A.No.104 of 2013 and in C.R.P.No.771 of 2013 dated 13.02.2013 and 16.11.2016 respectively, shall continue till 11.12.2017 only. Meanwhile, the petitioner can move the amendment petition, if she is so advised. It is made clear that the trial Court shall decide the case on its own merits uninfluenced by any of the observations made by this Court. No costs. Consequently, Miscellaneous Petitions pending, if any, shall stand closed.
