Heard Sri K. Venkatesh, learned counsel for the petitioner and Sri S.V. Ramana, learned Standing Counsel for the respondent-Corporation.
The petitioner herein was placed under suspension by order dated 12.8.2015 on the allegation that he attended the duty by consuming liquor. The order of suspension was passed pending disciplinary enquiry against the petitioner. Learned counsel for the petitioner submits that except the report of the Breath Analyser, there is no material against the petitioner, and therefore order of suspension is not warranted.
Since the order impugned is an order suspending the petitioner pending enquiry, it is not appropriate for this Court to examine the merits of the suspension order by evaluating the evidence. The writ petition is therefore disposed of directing the respondents to conduct enquiry and complete the same by passing appropriate orders as per law within a period of four weeks from the date of receipt of copy of the order. No order as to costs. Miscellaneous Petitions, if any, pending in this writ petition shall stand closed.
