O R D E R

The petitioner is a firm involved in construction activity. It is seeking for a direction to the respondents to pay admitted amounts under final bills of Rs.24,22,158 and Rs.23,93,975/-, for the works executed in terms of circle agreement dated 31.10.2013.

Learned counsel for the petitioner submits that this court in similar facts and circumstances in W.P.No.2416 of 2016 dated 03.02.2016 directed the respondents to release the amount with 6 per cent interest within certain time and in default, to pay the amount with interest at 12 per cent per annum instead of 6 per cent. Learned counsel seeks to pass similar order. Learned Assistant Government Pleader for Tribal Welfare, on instructions, does not dispute the same.

In view of the same, writ petition is disposed of directing the respondents to pay the admitted amounts under the final bills for the works executed in pursuance of circle agreement dated 31.10.2013, within a period of two months from the date of receipt of a copy of this order, within interest at the rate of 6% per annum from the date of expiry of three months from the date of entering of the measurements in M-Books.

It is made clear that if the respondents fail to make payment within the above stipulated time, they shall pay interest at the rate of 12% per annum, instead of at 6%, from the time as aforesaid.
